Guardianship papers for
the minor children of Joshua Dunnuck
|
Probably died April of 1839 (guardianship papers begin May 14, 1839)
|
At the time of Joshua's death he was a widower; his second wife Phebe having died ca. 1833-1834 in Fayette Co.
OH. He had just moved his family from Ohio to Indiana. Family lore has him dying a few months after his arrival
in the fall of 1838.
The surviving children by his first wife were:
..Phebe, age 25 wife to Absolom Ashbrook -- remained in OH,
..John W. age 23 just married (Oct. 1838) Presumably before their arrival in IND. in Fall of 1838
..Benjamin T. age 20 (in 1840 became guardian of Thomas - Thomas was still with him in 1850 - the returned to OH)
..Elizabeth. age 16 (not listed guardianship papers - remained or returned to OH - married in 1843 in OH
The surviving children by his second wife were:
..Dinah Ann age about 13 ---- Married 1847 - age about 21
..George B. age about 11 ---- died age 19 - living in 1847
..Thomas age about 9
..Sarah "Ruth" age about 7 --- Married 1849 - age about 17

Open Court, Kosciusko County, Indiana, May 15, 1839
(Benjamin Blue, friend & neighbor of Joshua, becomes guardian of four Dunnuck children)
Know all men by these presents that we Benjamin Blue and Daniel Underhill of Kosciusko County, are held and
firmly bound unto the State of Indiana in the sum of sixteen hundred dollars for the payment of which well &
truly to be make and done we bind ourselves, our heirs executors and administrators, jointly and severally firmly
by these presents: Sealed with ourselves and dated this 15th day of May AD 1839.
The condition of the above obligation is such, that of the above bond Benjamin Blue will truly and faithfully
discharge the duties and faithfully perform the trusts submitted to him as guardian of the persons and estates
of Benjamin T. Dunnuck, George B. Dunnuck, Dinah Ann Dunnuck, Thas. J. Dunnuck and Sarah Ruth Dunnuck infant heirs
of Joshua Dunnuck deceased, during the minority of the said infant heirs - and render to this court a just and
true account of his said Guardianship, when -- shall be thereunto be required --then the above obligation to be
null and void - otherwise to be and remain in full force and virtue in law-

(Benjamin T. DUNNUCK comes of age and assumes
guardianship of his half brother George)
Know all men by these presents that we Benjamin Dunnuck, Henry L. Farmer and Ludlow Nye are held and firmly bound
unto the State of Indiana in the sum of four hundred dollars for the payment of which well and truly to be made
and done, we bind ourselves, our heirs executors and administratiors jointly severaly firmly by these presents
sealed with our Seals and dated this 10th day of November A.D. 1840 - The condition of the above obligation is
Such that if the above bound Benjamin Dunnuck will truly and faithfully discharge the duties and perform the trusts
committed to him as a guardian of the person and estate of George B. Dunnuck infant heir of Joshua Dunnuck deceased
during the minority of the said George B. Dunnuck and render to this Court a just and true account of his said
guardianship when he shall be thereunto required then the above obligation is to be void and of none effect otherwise
to be and remain in full force and virtue in law signed sealed and delivered in presence of W. C. Graves.

To the honorable John R?ergen's, Judge of the Probate Court of Kosciusko County, Indiana
The memorials of Benjamin T. Dunnuck, and Benjamin Blue Guardians of the persons and estate of George B. and Dinah
Ann Dunnuck. Thomas S? Dunnick and Ruth Dunuck respectfully Sherwith that the personal Estae of the said above
mentioned haved which as come to the hands of your Memmorialists is insufficent for their Sustenance and Education.
that the undivided half of the East half of the north East Quarter of Section Twenty One in Township thirty
two Ranges East in Kosciusko County Indiana containing forty acres is the real Estate of the said George
B. Dunuck, Dinah Ann Dunnuck, Thomas J. Dunnuck and Ruth Dunnuck that said land is unimproved and inencumbered
by taxes which you canot be discharged by the availl of the personal Estate your memorialist therefore prays that
you honor moved make an order for the appraisment and private sale of the said prenaies and that the avails of
the same. after discharging the and incumbrencees may be made a fund in the hands of you Memmonialist for the sustenance
and Educaton of the Said above mentioned wards during their Minority and you memonalist ___

Money received from Real Estate Sale
February 8, 1847
Know all men by these present that we Benjamin T. Dunick, Benjamin Blue and John Dunnuck and Washington Bybee of
the County of Kosciusko in the State of Indiana are held and firmly bound unto the State of Indiana in the fund
sum of two hundred t__enty Dollars for the payment where of well and truly to be made we bond ourselves ___ _____
executors and administrator jointly and severally; by these present: Sealed with our seals and dated this 10 day
of November 1846.
The condition of the above obligation is such that if _h_ a___ connel Benjamin F. Dunick and Benjamin Blue will
truly and faithfull discharge the duties and preform the trust committed to him as Guardian of the Person and Estate
of George B. Dunnuck, Dinah Ann dunich, Ruth Dunnuck, Thomas J. Dunnick and will faithfully apply the moneys arising
from the sale of the Real Estate of said Heirs under and according to the direction of the Probate
Court of the County aforesaid, and render a just account thereof according to Law than the above obligation is
to be void and of none effect. otherwise to be adn remain in full force and Virtue.

Land Sold
Kosciusko Probate Court, August (1847)
The undersigned guardians of the persons and estate of Georg B. Dunnuck, Dinah Ann Dunnick, Thomas J. Dunick
and Sarah Ruth Dunick would respectfully report to this court that they have sold the real Estate of Said Marcy
as ordered by this court to Acquilla Hoff for the full acct of the appraisment to ____ p One hundred and ten Dollars
in cash all of shich is respectrully submitted. August 19, 1847 (signed B. Blue and B.T. Dunnuck)
